Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") are an agreement between you and BoltVine Private Limited ("BoltVine", "we", "us"), the company that operates the Aeotrak platform at aeotrak.com (the "Service"). By creating an account, purchasing a subscription, or using the Service — including the free scanner — you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to it.

2. The Service

Aeotrak monitors how brands appear in answers generated by AI engines (such as ChatGPT, Claude, Perplexity, Gemini, and Google AI Overviews), diagnoses why competing pages win specific answers, generates recommended fixes and draft content, verifies implemented fixes, and measures before/after results. Feature availability varies by subscription tier as described on our pricing page.

3. Eligibility and your account

• You must be at least 18 years old and capable of entering into a binding contract.
• You are responsible for the security of your sign-in credentials and for all activity under your account.
• Account information you provide must be accurate and kept up to date.
• One account per individual or organization. Team-seat features exist for sharing access — credential sharing outside them violates these Terms.

4. Subscriptions, billing and renewal

• Paid plans are billed monthly in advance through our payment processor, Razorpay. By subscribing you authorize recurring monthly charges to your payment method until you cancel.
• Prices are listed on the pricing page. Taxes may be added where applicable by law.
• We may change plan prices or limits prospectively. Price changes affecting an active subscription will be communicated by email at least 30 days in advance and apply from your next billing cycle.
• If a renewal payment fails, we will notify you and retry. Continued non-payment may result in your account being downgraded and paid features suspended.

5. Cancellation, refunds and plan changes

• You may cancel anytime from your billing dashboard. Cancellation takes effect at the end of the current billing period, and you keep access until then.
• Refunds are governed by our Refund & Cancellation Policy, which includes a 7-day money-back guarantee on your first subscription payment.
• When you switch plans, the new subscription starts once its first payment succeeds, and the old subscription is then cancelled. Unused time on the old plan is not carried over or refunded.

6. Acceptable use

You agree not to:

• Monitor domains or brands you do not own or lack authorization to act for.
• Reverse-engineer the Service, probe or breach its security, or circumvent rate limits, tier limits, or access controls.
• Resell or provide the Service to third parties as your own offering without our written agreement.
• Use the Service for any unlawful, deceptive, infringing, or abusive purpose, or to send spam.
• Interfere with the operation of the Service or impose an unreasonable load on our infrastructure.

We may throttle, suspend, or terminate accounts engaged in abuse, with notice where practicable.

7. Your content and ownership

• You retain all rights to the information you provide (your domain, prompts you curate, account data). You grant us the limited license needed to operate the Service on it — e.g., crawling the pages of the domains you register and querying AI engines with your prompts.
• The Service and its software, design, and branding remain the property of BoltVine Private Limited. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription.

8. AI-generated output

• Content generated for you (schema markup, drafts, recommendations) is yours to use once delivered. We apply automated safeguards against fabricated claims, but AI output can contain errors — you are responsible for reviewing generated content before publishing it.
• Visibility scores and diagnostics are point-in-time measurements of third-party AI systems that change continuously. They are analytical signals, not guarantees of ranking, traffic, or revenue outcomes.

9. Third-party services

The Service depends on third-party providers — including AI model providers (Anthropic, OpenAI, Google, Perplexity), payment processing (Razorpay), hosting and infrastructure — whose availability and behavior we do not control. Outages or changes at these providers may affect monitoring runs; failed runs are retried automatically. Your use of AI-engine answers remains subject to those providers' own terms.

10. Availability

We work to keep the Service available and performant but do not warrant uninterrupted or error-free operation. We may modify features over time; if we discontinue a material paid feature, we will provide reasonable notice.

11. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by law, BoltVine Private Limited will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim.

13. Indemnification

You will indemnify and hold BoltVine harmless from claims arising out of your content, your use of the Service in violation of these Terms, or your publication of generated content without review.

14. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate your access for material breach of these Terms or non-payment. Sections that by their nature should survive termination (ownership, disclaimers, liability limits, indemnity) survive.

15. Changes to these Terms

We may update these Terms from time to time. For material changes we will email account holders at least 30 days before the changes take effect. Continued use after the effective date constitutes acceptance.

16. Governing law and disputes

These Terms are governed by the laws of India. Subject to applicable law, the courts having jurisdiction over the registered office of BoltVine Private Limited in India will have exclusive jurisdiction over disputes arising out of these Terms or the Service.
